What To Expect When You Make A Medical Negligence Claim
When you make a medical negligence claim with us, your recovery is our priority.
Most of the claims we handle are on a no win no fee basis. This means that there’s never anything for you to pay while your claim is going through. You’ll only ever pay anything if your case is successful, and that money will come out of your compensation award.
We’ll investigate your case thoroughly. As early as possible in the process we’ll try to get the NHS or private healthcare provider responsible for your injury to accept liability.
If they admit fault for your injuries, then we can try to get some of your compensation before your case settles. These “interim payments” can help pay for things to help your rehabilitation – such as therapies, specialist care or adaptations to you home. They can also help ease financial pressures you’re facing due to not being able to work.
Medical negligence claims involving life-changing injuries will usually take a few years to settle. It’s important to understand the impact of your injuries on your life over the longer term. This is because we need to see how far you’re able to recover to make sure your claim is properly valued.
While your claim is progressing our Support & Rehabilitation team can help with day-to-day issues you may face. This can range from putting you in touch with specialist support groups or therapists, through to helping you to make adaptations to your home. We‘re here to help, all the way through your recovery.

Case Study: Newcastle Couple’s Heartbreak Following Negligent Maternity Care
Axwell Savcak died less than an hour after being born in Newcastle’s Royal Victoria Infirmary. He was the ‘miracle’ baby that his parents, Vaida and Aleks, had been trying to have for nine years.
Axwell was delivered in a poor condition by caesarean section. His mum’s labour scans showed several decelerations in Axwell’s heart rate. A heart rate scan monitor became ‘pathological’, which showed Axwell could be in distress.
Once Axwell had been delivered, doctors tried to resuscitate him, but he tragically died just 50 minutes later. The post-mortem showed that he’d died from complications caused by being starved of oxygen.
Distraught, Aleks and Vaida instructed our expert medical negligence lawyers to help investigate their care under Newcastle upon Tyne Hospital’s NHS Foundation Trust. The trust apologised, admitting a breach of duty. It was concluded that a caesarean section could have been performed sooner. This meant Axwell could have been born almost three hours earlier.
“Trying to come to terms with what happened is something I don’t think we’ll both ever get over. What should have been the happiest day of our lives turned to total despair. When we lost Axwell our lives changed forever. “
“We had so many plans for the future and all we wanted was to bring Axwell home with us. Having to leave hospital and him behind was heartbreaking.
We know nothing can make up for what’s happened but we take some small comfort as to at least now having answers to the many questions we had. However, we want to let others going through the same emotions as us following the loss of a baby, that it’s not their fault. They don’t have to suffer alone as help and support is available.”
Vaida, Axwell’s mother
“Axwell’s death is a stark reminder of the heartbreaking consequences families can be left to face because of care failings. While we welcome the Trust’s admission it’s now vital that lessons are learned to improve maternity safety for others.
In the meantime we continue to support Vaida and Aleks to ensure they can receive the specialist support they require to try and come to terms with their ordeal the best they can.”
Lindsay Cole, Solicitor
