What To Expect When You Make A Medical Negligence Claim
We know it can be daunting to make a compensation claim and we understand the hardship you may be going through – not only with your injuries, but also financially. Our team is experienced and know exactly what needs to be done to improve things.
When you make a claim with us our first job will be to investigate your treatment concerns. We’ll then try and get the organisation responsible for your injuries to admit fault and provide a formal apology. It’s important to establish this early on in your case, as it can then help us to claim interim compensation payments. Interim payments are early compensation payments that are made while your claim is going through. They can cover your expenses for things like physiotherapy or making adaptations to your home. They can also cover your loss of earnings.
We’ll offer you the services of one of our Support & Rehabilitation specialists at the start of your claim. Our Support & Rehabilitation team is there to help make your life easier. They can help you get access to specialist rehabilitation and support services, as well as state benefits.
Your medical negligence claim could well take a few years to settle. This is because it can take a while to understand how far you’ll recover from your injuries, and how they’ll impact your life in the long-term. While your claim is going through, we’ll work hard to make sure you have the compensation and specialist support you need.

Lessons To Be Learned After Hospital Trust Incorrectly Recorded Cancer Sufferer's Smear Result As Normal
A 34-year-old woman is calling for lessons to be learned after being diagnosed with cervical cancer even though her first smear test was incorrectly reported as normal.
The woman, of Old Swan, Liverpool, suffered a treatment delay of over three years after her screening results were wrongly classed as negative. She was told she didn’t need to go to an appointment until she was routinely recalled. The result didn’t highlight suspected cell changes as it should have. After being called for her routine smear, her results showed severe cell changes. Following further tests, the woman, who doesn’t want to be named, was diagnosed with cancer a month later.
After her diagnosis, she contacted our medical negligence lawyers to investigate. Liverpool University Hospitals NHS Foundation Trust admitted a breach of duty on behalf of the former Royal Liverpool and Broadgreen University Hospitals NHS Trust, who oversaw analysing the woman’s test results.
The woman’s cervical cancer has resulted in fertility issues. We secured interim payments from the Trust to fund her surrogacy in the USA.
“Our client’s case is sadly another reminder of the consequences women can be left to face through the incorrect recording of smear tests. The last few years and coming to terms with her diagnosis and what it means for her long term has been incredibly upsetting for her.
“While we can’t make up for what’s happened, we’re pleased that we’ve been able to establish the answers that she and her partner deserved.” – Sharon Williams - Senior Associate Solicitor
