What To Expect When You Make A Medical Negligence Claim
We understand the emotions you may be experiencing if you’ve suffered medical negligence. You may have worries about the future, your recovery, as well as the financial impact of your injuries. Our solicitors are here to help you – not only in getting the compensation you deserve, but also in helping you make the best recovery possible.
When you make a medical negligence claim with us, our priority is you. We’ll immediately start work on investigating your treatment concerns with a view to getting an early admission of fault from the NHS or private healthcare provider responsible for your injuries. If we can get that admission, it usually means we can get an interim compensation payment to help pay for your care. This can ease any immediate financial worries you may have.
We can also assign you one of our Support & Rehabilitation specialists. Their role is to help make your life easier – from completing benefit applications, through to introducing you to local charity/support groups. Our Support & Rehabilitation teams have considerable knowledge. They can identify things you might need to help with your recovery – and how we can go about getting them for you (for instance getting a wheelchair ramp installed at your home).
Depending on the complexity of your claim, medical negligence cases can take a few years to settle. This is because we need to see how well you’re able to recover from your injuries, and assess the longer term impact on your life. Settling a claim too early could mean you get less compensation than you’re entitled to.
Our specialist team will be with you through every step of the process and will fight to get you what you need.

Birth Injury At University Of Wales Hospital
Our medical negligence lawyers were able to get £1.6 million for a little boy who was diagnosed with Erb’s Palsy.
The boy was born at University of Wales Hospital in Cardiff. Staff at the hospital decided to progress with a natural delivery of the boy, despite him becoming distressed during labour.
Tests later revealed that the boy has Erb’s Palsy – a type of paralysis caused when nerves in the arm become damaged.
The boy’s parents approached our Medical Negligence team to investigate his care. We found that he wouldn’t have been injured if he’d been delivered by caesarean section. His injuries were made worse when staff failed to properly manage the delivery when one of his shoulders became stuck.
Cardiff and Vale University Health Board admitted responsibility for the boy’s injuries. We managed to get the family a £1.6 million compensation settlement. This money will pay for the specialist therapies and support that the boy will need for the rest of his life.
The boy’s parents said:
“Our son has shown incredible courage throughout his life. He is the most wonderful son we could have wished for. We are incredibly proud of everything he has been able to achieve so far, often in the face of adversity.”
“While nothing will ever change what we have all been through, this settlement at least means we can rest assured that he will always be supported and hopefully be able to get the best from life for many years to come.”
“It remains difficult to think about how things could have been different if we had received better support. Our only hope now is that lessons have been learned so no one else faces the same issues. Patient safety must always come first.”
