The Pensions Regulator has announced it is stepping up its efforts to ensure auto-enrolment compliance by carrying out spot checks on a nationwide basis. The Regulator has already descended upon London-based employers in March, Greater Manchester employers in April and May, and is now moving onto Birmingham. It is understood it will be moving around the country looking at employers in a number of different cities over the next few months.
The focus is on employers who are ignoring their auto-enrolment duties.
As well as powers to force employers to provide evidence of compliance with auto-enrolment, the Pensions Regulator has a wide range of enforcement powers ranging from fines of £400 fixed penalty to varying daily escalating penalties from £50 to £10,000. There are also civil penalties which the Pensions Regulator can impose on both companies £5,000 and directors £5,000 individually where there has been wilful non-compliance.
