Serious Injury Lawyers Secure Payment To Fund Cyclist’s Specialist Rehab
A teenager suffered a life-changing brain injury when he was hit by a speeding motorcyclist travelling at up to 70mph.
James Donovan suffered a catalogue of life-threatening injuries including bleeds on the brain, a torn spleen, two collapsed lungs and multiple fractures, when he was crossing Somnes Avenue in Canvey Island on his bicycle.
The then 17-year-old, of Canvey Island, was airlifted to hospital where he was put in a coma. He spent a total of seven months in hospital before being transferred to a rehabilitation unit for four months.
James did not return home for around 11 months. He had hoped to become a mechanic but his ongoing symptoms mean he is unlikely to be able to work.
Family asks serious injury lawyers to help James access specialist support
Following the crash, James’ family instructed expert serious injury lawyers at Irwin Mitchell to help investigate and secure the specialist rehabilitation, support and therapies he requires.
In a civil case brought by Irwin Mitchell, investigations determined that the motorcyclist had been travelling at around 70mph in a 40mph zone immediately before the collision.
Legal experts secure six-figure payment to fund rehab package
An agreement on liability between James and the motorcyclist’s insurers has been reached. Irwin Mitchell has secured James, now aged 21, a six-figure interim payment to fund the ongoing rehab he requires. The High Court has approved the liability agreement and interim payments.
James’ family have now spoken for the first time about how the crash has “devastated” his life.
They’ve joined their legal team at Irwin Mitchell in issuing a road safety warning and in particular, the dangers of speeding.

Expert Opinion
“The last few years and coming to terms with the collision and the serious injuries James suffered have been difficult for him and his family.
“While he’s made good progress in his recovery, James still faces many challenges which are expected to affect him for the rest of his life.
“Nothing can make up for what he’s been through. However, we’re pleased to have secured a liability agreement and funds ensuring James can access the rehab he needs to make the best recovery he can.
“We join James’ loved ones in urging people to take care on the roads. His case is a stark reminder of the life-changing consequences people can be left to face when road safety isn’t upheld.” Laura Middleton-Guerard

James' family reveal impact of brain injury as they issue road safety warning
James’ nan, Joan Neal, 69, said: “Before the crash James was an active teenager. He was independent. He had been out on his bicycle and was on his way home when the collision occurred.
“However, that’s all changed because of his injuries. While we’re thankful he’s still alive James isn’t the same person he was and lives with the physical and mental effects of what happened.
“Our focus now is on supporting James and helping him try and make the best recovery he can.
“We know he faces an incredibly long and difficult journey, but we’re determined to do all we can to help him.
“However, we just hope that by speaking out, others will be aware of how important road safety and staying within the legal speed limit is. Lives can be devastated in a split-second. Our family wouldn’t want anyone else to go through the suffering James is.”
