We recently secured £22 million for Mike*, a 13-year-old boy who suffered a severe brain injury due to poor management of his mother’s labour.
What happened to Mike?
Failure to take fetal blood samples, as well as a failure to advance his delivery resulted in complications during Mike’s birth.
These failings led to Mike suffering a severe brain injury which has completely altered his life forever. Mike’s brain injury was caused by an extended period of chronic partial hypoxic-ischaemic insult.
What impact has this had on Mike’s and his family’s life?
Mike is now 13, but he continues to face life changing challenges. He has whole body cerebral palsy and significant learning difficulties. He has also been diagnosed with autism secondary to his brain injury. He requires continuous care and is unable to involve himself or experience the independence of his teenage years.
Mike’s disabilities impact his family’s life in every way. Mike doesn’t like going to new places and struggles with transitions.
His behaviour is also challenging, especially at home, which means he needs additional support, making everyday activities a struggle. This means it difficult for the family to go out on outings together. Family life revolves around Mike’s needs which limits what the rest of the family can do.
How we helped?
Mike and his family contacted us to help get compensation for his injuries and the support he now needs.
Senior Associate Solicitors, Rebecca Cherry and Ania Bean, worked with Mike and his family to secure compensation to help Mike be as independent as possible in the future.
A claim was brought against the Royal Berkshire NHS Foundation Trust for their failures at the time of Mike’s birth. Liability was disputed, but we were able to prove his injuries were caused by their negligence.
After liability was accepted at 85%, we were able to secure interim payments for Mike to put care and private therapies in place. Mike’s family also used the payments for house adaptations and a more suitable vehicle.
Overall, Mike will receive £22 million in compensation. This substantial sum not only reflects the severity of the negligence and the injury suffered but also the commitment of our medical negligence experts in securing justice for Mike. The compensation received will make sure Mike’s ongoing needs can be met for the rest of his life.
After the claim was settled, Mike’s mum said: “Thank you so much for everything you and your team have done for us.”
