What Are The Time Limits For Making A Claim?
You usually have three years to start your claim following your head or brain injury.
However, there are some notable exceptions to this:
- Mental capacity – there's no time limit if someone lacks capacity. But if you regain mental capacity then the normal three year limit applies. Time limits can be complex in these cases and it’s our policy to start a claim within three years, even where someone lacks mental capacity.
- Children – any point until they turn 21.
- Claims being made abroad – limits can vary, and often be shorter.
- Criminal assaults – two years.
It’s best to contact us as soon as you can to make sure your brain injury claim starts within these time limits.

How Long Will Your Claim Take?
Brain injury claims will usually take at least three years to settle. This is because it can take several years to fully understand the impact the injury will have on your life. While this might seem like a long time, settling a claim too early could lead to your case being undervalued.
However, while your claim is ongoing you’ll often get some of your compensation early to help pay for your care. These “interim” payments are available where the person or company responsible for your injury admits fault at an early stage in your claim. Interim payments can help pay for rehabilitation and help to ease financial hardship, for example if you’re no longer able to work.
