Judgment Handed Down Following Final High Court Hearing
Irwin Mitchell has successfully acted in a recent complex High Court case related to transgender family law.
Scott Halliday, Head of Complex Children Law and a Family Law Senior Associate in Leeds and London, instructed Tom Wilson of counsel 1GC Family Law to act for the successful parent in a recent case, in the High Court in O v P & Anor [2024] EWHC 1077 (Fam) (08 May 2024).
The three-day final hearing before Mrs Justice Judd in April 2024 related to a sensitive matter of whether or not a transgender young person, now aged 16, should be able to embark upon a referral to a private medical clinic to progress with an assessment and/or future treatment pathway.
The parents held differing views on the situation. Irwin Mitchell acted for the parent whom wished to support the young person who wished to embark on the referral and /or future pathway.
After hearing the complex arguments over the course of three days at a final hearing Mrs Justice Judd provided a judgment which confirmed that the young person should be able to progress with a referral. The Judgment sets out the legal basis for that decision.
