Our military injury solicitors secured a settlement of £400,000 for our client, Mark*, who was injured while taking part in a military exercise.
What happened to Mark?
Mark joined the Army and served for 13 years. He was re-enlisted in 2018 and intended to serve a full military career.
Later the same year, while serving in Kenya, Mark was involved in an accident during a nighttime range training exercise. This led to his medical discharge from the military in 2023. The task was a “Black Attack”, which is an exercise run at night without any lights and using only Night Vision equipment.
Mark wasn’t given any information about potential hazards or the terrain before the exercise began. While jogging across the range, he fell into an unmarked and unlit hole, approximately 60cm deep. He climbed out of the hole and carried on with the exercise but fell down another hole after going only a few metres further.
Mark had several MRIs and x-rays, which showed he’d dislocated his fibula from his knee, which had caused damage to the ligaments. He’d also sustained an injury to his foot, which means he can’t bear much weight. Although Mark wished to continue his career in the Army, he’s now medically unable to do so.

Our team got to work straight away and started by gathering medical and employment evidence to support his claim. It soon became clear that, without his injury, Mark could have continued his military service.
Medical records showed that Mark had been left with ongoing painful symptoms in his right foot. He also has a lack of function and struggles to walk long distances, walk on uneven surfaces, or do any type of sport.
A £400,000 settlement
We were able to present this strong evidence to the Ministry of Defence (MOD), who admitted a breach of duty and agreed to pay compensation for Marks’ injuries.
Our solicitors made sure Mark’s compensation was a full reflection of the costs of any psychiatric support and physical rehabilitation he needed. This included physiotherapy to help mobilise his foot.
We secured a compensation settlement of £400,000 for Mark. This money will help him, and his family move forward with their lives.
