Our solicitors secured a £90,000 settlement for our client Charlotte* after she experienced life-changing injuries during her pregnancy, labour and delivery of her first child. We were able to prove these injuries were caused by negligent treatment and could have been avoided with proper care.
Charlotte’s story
Charlotte experienced negligent care while she was pregnant with her first child. This medical negligence happened both while she was carrying her unborn baby and during the labour and delivery.
The authority in charge of Charlotte’s care failed to refer her for a growth scan, which would have shown that her baby was large for gestational age, and advise her appropriately as to the mode of delivery. They also failed to proceed to a c-section during delivery after abnormal CGT and blood test results.
As a result of this negligence, Charlotte sustained an avoidable second-degree tear and pelvic floor damage. She’s also been left with permanent urinary incontinence.
How did we help?
Charlotte contacted our solicitors to bring a claim against Betsi Cadwaladr University Health Board for the injuries she sustained.
Our specialist pregnancy and gynaecology injury solicitors collected independent medical evidence from an obstetrician, urogynaecologist, and midwife. Through their expert opinions, it was concluded that the health board had failed in their duty of care on multiple occasions during Charlotte’s pregnancy, labour and delivery.
The claim was issued at Court and the health board admitted liability for Charlotte’s injuries.
A five-figure settlement
We were successful in securing £90,000 in compensation for Charlotte.
This money will help her to access private therapies and treatment for her bladder injuries. Charlotte has also developed a psychiatric condition because of her experience, so the compensation will also help to pay for therapy.
Charlotte’s claim was handled by Amy Makin, an Associate Solicitor in our medical negligence team. Amy commented on Charlotte’s case: “It was a privilege to be able to secure compensation for Charlotte. It’s incredibly frustrating to hear how easily such significant injuries could have been avoided if those in charge of her care had provided appropriate care and treatment..
“The experience of having her first child has been a traumatic one for Charlotte. I hope the private treatment and therapy she can now afford will help her and her family to move forward towards a bright future.”
