The Accident
Our client, Carol*, was walking in a residential area of Menorca when she was knocked down by a vehicle. The vehicle struck other pedestrians and, tragically, one of them lost their life. The driver was arrested by the police at the scene.
Carol suffered injuries so severe that she's since had amputations and revision surgeries. As a result, she’s needed specialist aids, equipment, and prosthetics. As her injuries worsened, it became clear her home wasn’t suitable for her needs.
A Spanish law firm originally represented Carol. They mistakenly told her she couldn’t bring her claim in England and also advised her to accept a low offer of compensation from the driver’s insurer. The offer she was advised to accept was around 10% of the final settlement we secured for her.
How We Helped
Unhappy with this low compensation offer, Carol contacted our international serious injury team. After an initial discussion, she decided to move forward with us.
We took over the case and started to prepare for an expected trial. We managed to get interim payments for Carol. These helped her to pay for equipment, surgery, and carers.
Carol's severe injuries meant she needed ongoing surgeries. Because of the severity of her injuries, we got several medical experts to help us. Various updated assessments were needed, including assessments by pain and prosthetic experts.
Even though her claim could be brought in England, Spanish law applied as to how the claim was valued. This meant we worked closely with a top Spanish lawyer and leading counsel.
A Seven-Figure Settlement
Due to the circumstances surrounding the accident, we didn’t need to prove the driver was responsible. However, further work was needed to properly value the claim given the severity of Carol’s injuries and the fact that the accident happened in Spain.
The case was listed for trial in September 2023. After a joint settlement meeting (JSM) in April 2023, we reached a compromise.
We managed to secure a seven-figure compensation settlement for Carol. She’s now able to buy a home that can suit her future needs better. She’ll also be able to access state of the art prosthetics to help her lead a normal life.
