Our Serious Injury solicitors have secured a seven-figure settlement for a woman who was run over by a car while crossing a road near her home.
Karen*, from Kent, sustained serious and life- changing injuries in the collision that left her husband as her main carer.
She suffered a traumatic brain injury as well as a fractured pelvis and soft tissue damage. The brain injury had a particularly devastating impact on Karen’s life. She experienced post-traumatic cognitive impairment, including a notable personality change and the loss of smell and taste.
She also struggled with balance and mobility, and developed both anxiety and depression. Doctors agreed it was unlikely Karen would ever return to work.
Karen contacted our Serious Injury team to see if we could help. We investigated the events of that day fully, including setting up a reconstruction of the collision to see if Karen or the driver could have avoided the accident. We also got hold of CCTV footage from a nearby takeaway for a clearer view of what happened, and accessed Karen’s medical records.
Our reconstruction proved that whichever way Karen crossed the road that day, she would have been visible to the driver for long enough for him to have braked and avoided hitting her.
We used this as evidence that the driver was partly responsible for the accident, and agreed a seven-figure compensation settlement for Karen from the driver’s insurers.
This money will allow Karen to continue with her rehabilitation and will pay for the things she needs to make her life easier, such as an access-level home.
