Our Serious Injury Lawyers have secured compensation for a cyclist who suffered a severe brain injury after being hit by a motorbike.
Jack* was cycling across a road with a 30mph speed limit, when he was hit by a motorbike travelling at approximately 51mph.
The impact threw Jack from his bike and he sustained very serious injuries, including a traumatic brain injury. He was taken to hospital where he was unconscious for several days, and experienced post-traumatic amnesia for two weeks after that.
While Jack was unresponsive, his mother Debbie* got in touch with our Serious Injury team to see if we could help. It became clear after Jack regained consciousness that the impact of the accident was severe and that he’d need specialist care for a considerable amount of time.
For a while after the collision Jack was highly agitated and impulsive, to the point that he needed specialist medication. A neuropsychiatric assessment noted abnormal symptoms such as high levels of anger and anxiety, excessive fatigue and some obsessive compulsive behaviours.
He was living a ‘sheltered life’ after the accident and was more dependent than usual on his mother. Jack’s brain injury meant that he didn’t have the mental capacity to make a compensation claim himself, so Debbie continued the fight on his behalf.
We began a thorough investigation of the accident. During negotiations with the motorcyclist's insurers, we showed that the accident wouldn't have happened if the motorcyclist had stuck to the speed limit. We were then able to agree a seven-figure settlement to help pay for Jack's ongoing care and rehabilitation. Although Jack was initially reluctant to accept help, this settlement helped him to access the rehabilitation and support he needed to start to rebuild his life.
