Our asbestos related disease solicitors helped a man and his wife secure future payments for non-NHS funded treatment if he needs them.
Mr K worked as a nuclear research scientist for the Central Electricity Generating Board (CEGB, now Magnox Limited) at Berkeley Power Station.
He was employed at the power station in the early 60s and worked on high temperature experiments which used large amounts of asbestos. This direct exposure caused Mr K to inhale asbestos fibres on a daily basis.
Years later, Mr K was diagnosed with mesothelioma. After he was diagnosed, Mr K collected detailed evidence, including specific research papers, to show CEGB was responsible for his disease.
The nurse treating Mr K suggested a list of solicitors specialising in lung cancer claims. After researching the list, Mr K contacted our asbestos team to see if we could help.
We took on Mr K’s case and started to prepare the evidence we needed. Isabelle Selley, an expert at asbestos disease claims, took witness statements and gathered medical reports form Mr K’s respiratory physician and an expert oncologist.
We used this evidence to make a claim against Magnox Limited. They admitted responsibility almost immediately and awarded Mr K with a substantial interim payment to cover his costs while the claim continues.
Although Mr K’s health remained stable throughout the claim, he was concerned about the future. He wanted to ensure that Magnox would pay for non-NHS funded treatment if his health got worse.
We negotiated with Magnox and successfully secured payment to compensate Mr K and his wife for his situation and shorter life expectancy. Magnox also agreed to pay for any future non-NHS funded treatment suitable for Mr K.
Securing payment for future treatment was a huge reassurance for Mr K. The interim payment he received also meant his wife wouldn’t have to worry about their finances.
Isabelle Selley said: “Negotiating an order for the payment of future treatment is a huge outcome and we’re pleased Magnox accepted responsibility so quickly and realised the harm they’ve cause [Mr K] and his family.
We hope [Mr K] can get the treatment he deserves and live as comfortably as possible going forward.”
