Our military injury claims team successfully secured a settlement for a serviceman who was injured while on duty.
James* was posted to the Falklands when his accident happened. He was on duty as a marshal for a go kart track that was set up for a welfare day for the community.
James received safety training before the event. The training included instructions on what to do if there was an incident on the Go Kart track. If something happened, James needed to signal with a flag and then enter the track to help anyone involved in the incident. The flag would let kart users know to slow down while a marshal was on the tracks.
On the day of the event, a kart crashed into a barrier so James signalled with his flag to show he was entering the tracks. While he was helping the crashed kart, another kart came around the bend and collided with James and the kart he was already helping.
James was pinned between the two karts, crushing his leg and causing a fracture to his tibia and a dislocated ankle. Unfortunately, these injuries caused James to be medically downgraded from his position in the military because he couldn’t take part in his day-to-day activities for very long.
