Our specialist industrial disease lawyers have secured a landmark compensation agreement for a Leeds man who developed mesothelioma after being exposed to asbestos at work.
We believe our client had been exposed to asbestos while working for John Atkinson & Sons Limited, where he cut asbestos insulation boards by hand, creating harmful dust particles. He contacted specialist asbestos-related disease lawyers at our Leeds office after he was diagnosed with mesothelioma in 2015.
Mesothelioma is a form of lung cancer caused by breathing asbestos particles. It can take decades before symptoms begin to show but once they do the disease is very aggressive and, eventually, fatal.
Treatment for mesothelioma is advancing quickly and our team worked to make sure our client would be covered for all future changes, no matter what that treatment is and no matter how long it lasts for.
The landmark agreement in this case sets up periodic compensation so our client won’t have to wait until doctors decide on a treatment or estimate costs before claiming compensation. His current agreement will ensure all of his treatment costs are covered. For example, if different drugs are recommended by his doctor then payments would change to match the new therapy cost.
This is the first agreement of its kind for a mesothelioma case.
Ian Toft, a Partner at Irwin Mitchell and the asbestos-related disease specialist representing the man, said:
“Unfortunately none of the treatment available to this Claimant can be obtained on the NHS, free of charge. This Order has now put the structure in place to ensure that whenever the treatment is needed, it is covered. It gives our client some much needed peace of mind at such a difficult time of his life.”
“This is a landmark agreement which provides security for a man who needs it due to his devastating mesothelioma diagnosis.”
