Our expert Serious Injury team have secured a compensation settlement for a cyclist who was involved in a collision with an off-road motorbike.
Our client, "J", was cycling on a tow path for pedestrians and cyclists when a motorbike hit him at speed.
J suffered a serious brain injury, a fractured skull, injuries to the nerve in his left eye and his right ear, as well as various soft tissue injuries.
J asked our Serious Injury solicitors to investigate the incident, to see if he could claim compensation.
Because the motorbike driver was uninsured, we proceeded to make a claim against the Motor Insurers' Bureau. They raised several arguments against our case, including the motorbike driver's denial of negligence and the fact that J was not wearing a cycle helmet.
We were able to disprove the above arguments using evidence from a range of experts. The Motor Insurers' Bureau eventually took full responsibility.
As a result of his injuries, J still has problems with his memory and planning. He also suffers from behavioural and psychological issues, becoming impulsive and irritable. J has difficulty sleeping, and also suffers from impaired vision and hearing, as well as a reduced sense of taste and smell.
J worked for his father-in-law, who had planned to retire in early 2016, with J inheriting the business. J was very keen to get back to work, and he returned to his role only six months after his accident. However, due to the effects of his injuries, it would no longer be possible for him to take over the business.
We were able to fund private neuropsychology and the fitting of an advanced hearing aid. This helped with J's rehabilitation, as he was very determined to focus on work, which took up the majority of his time.
J and his family lived near the site of the accident, which served as a constant reminder of his ordeal. They eventually moved to a larger home, which helped give space to other family members when J's mood swings caused conflict.
Our Serious Injury solicitors were able to negotiate a compensation settlement for J that included a lump sum of over £500,000 and annual payments of £10,000 for the rest of his life. This will be used to cover the support he needs following his father-in-law's retirement.
J also received advice from our Court of Protection team and Asset Management in relation to a Personal Injury Trust, and investment options.
