Asbestos Related Disease specialists at Irwin Mitchell have secured £192,500 for Mr S who was sadly diagnosed with mesothelioma at the age of 70.
Mr S worked as a pipe fitter at a clay pit for Newton Abbot Clays Limited between 1959 and 2000. The company later changed its name to Watts Blake Bearne & Co Limited and was eventually taken over by Sibelco UK Limited, between 1959 and 2000.
As a pipe fitter, Mr S’s work included repairing pipework lagged with asbestos insulation. In order to access the site of a repair, he removed the surrounding asbestos insulation using a hammer a chisel. He was also in the vicinity when teams of laggers worked around him re-applied asbestos insulation to the pipework after the repair work had been completed. Mr S also used hand saws and power saws to cut up asbestos sheets used to form the roofs of outbuildings and sheds on the clay pit site. As a result of his work, he was exposed to vast quantities of asbestos dust and fibres released into the air.
The Defendants admitted liability in July 2016 and promptly agreed a settlement amounting to £192,500. The settlement also included a payment of £2,260 in respect of hospice care costs. Overwhelmed by the support and opportunities provided to him by his local hospice, Mr S was delighted to be able to offer the hospice this sum as a token of his appreciation.
Laura Wilkinson, a Solicitor specialising in asbestos related disease claims, commented, “Mr S’s main concern was how his wife would cope financially after his death. I was pleased to secure compensation for Mr S during his lifetime, which gave him the reassurance of knowing that his wife would be provided for in the coming years.”
“There was the added bonus of securing recovery of care costs for the hospice that had helped Mr S and his family so much over the course of his illness. It was recovered at a time when the hospice was struggling financially due to a cut in Government funding. Unfortunately, this is becoming an increasing problem for hospices around the country.”
