You must have testamentary capacity to make a Will. To show you have testamentary capacity you must not be suffering from a disorder of the mind, and you must:
Understand what a Will is and the effect it will have
Have knowledge of the assets you own that will pass under your Will
Be aware of any individuals who could, if not included in your Will, have a claim on your estate.
For example, you can choose not to include a child in your Will however you must be aware they could reasonably be expected to be provided for and their exclusion may result in them bringing a claim against your estate.
