Our Serious Injury team secured compensation for a retired man who suffered a bleed to the brain after being knocked down when crossing the road.
Paul was crossing at a recognised crossing point when he was hit by a car exiting a nearby roundabout. He was thrown onto the bonnet and fell to the floor.
He was taken to hospital, where he was diagnosed with a bleed on the brain.
His injuries mean that he suffers from headaches, dizziness, fatigue and issues with his balance. Paul already had vascular dementia, which is caused by restricted blood flow to the brain. The accident also caused his dementia symptoms to get worse.
Associate solicitor David King and solicitor Emily Greensmith submitted a claim to the motorist’s insurers, who denied that the driver was responsible for the accident.
The insurers argued that the driver was wearing sunglasses, had her sun visor down and had reduced her speed because of poor visibility. They also said the driver wouldn’t have been able to stop before exiting the roundabout.
Our in-house collision investigator found that the driver could have adjusted her speed to drive around Paul or even stop altogether. The investigator said that the sun wouldn’t have been as problematic as at most other times of day. The driver also shouldn’t have proceeded if she couldn’t see that the road ahead was clear.
The motorist’s insurer eventually admitted responsibility, but maintained that Paul was partly responsible for the accident and that he should receive reduced damages.
Our solicitors successfully negotiated a settlement that took into account general damages for pain, suffering and the impact on Paul’s enjoyment of life. It will also cover the cost of occupational therapy, physiotherapy and neuropsychology, and compensate Paul’s wife for her time spent caring for him.
The settlement will help Paul make the best possible recovery from the accident and manage his symptoms in the future. “I want to thank Dave King and Emily Greensmith for all the work done to claim compensation,” he said, “it seemed a long and daunting task, but was eventually successful.”
