What Is The Regulatory Enforcement & Sanctions Act?

The Regulatory Enforcement & Sanctions Act (2008) was designed to make local authority regulatory services more effective and efficient. It also introduced a number of civil sanctions for regulatory offences, which means the regulator can act more quickly than through criminal proceedings.

The advantages to businesses of this system are:

  • Criminal penalties may be avoided, saving the cost and embarrassment of a full conviction
  • The legal processes surrounding regulated areas are more transparent and easier to understand
  • The regulators must publish guidance for businesses and report their activities every year
  • The act is designed to kick start a process for improvement as opposed to punishment, allowing the authorities to encourage businesses to make the any changes needed and to ensure that businesses act within the given regulations

Irwin Mitchell And The RESA

The act offers businesses the chance to avoid prosecution after breaking regulations. To have the best chance of this happening, it’s important to get expert legal advice from lawyers who can negotiate effectively with regulatory bodies and get the best result.

We have extensive experience in dealing with RESA cases. We can explain to you in plain English what your position within the law is and offer you professional advice about the best course of action for you and your business. We can help you provide documentary evidence in support of your case and guide you through the process from start to finish, allowing you to protect your business’s best interests with confidence and ease.

We prioritise clear communication. This means that even when your legal circumstances are complex, we will work hard to make sure that you are fully informed and involved in the progression of your case at every step of the way.
